The detailed general terms and conditions of sale below govern the contractual relations between any user of the site https://pearls-and-colors.com/eshop/.
https://pearls-and-colors.com/eshop/ reserves the possibility to adapt or modify at any time these general terms and conditions of sale. In the event of an amendment, the general sales conditions in force on the day of the order will be applied to each order.
The User who has validated an order will then be called "Buyer". The User's rights and obligations necessarily apply to the Buyer.
It is specified that the Products are intended for personal use of the User, without any direct relation to the professional activity of the User.
The User who would like to buy on the Site declares to have full legal capacity.
Any order of a Product proposed on the Site requires the express consultation and acceptance of these General Terms and Conditions of Sale, but this acceptance is conditioned by a handwritten signature from the User.
In accordance with the legal provisions, it is recalled that the validation of the order form as specified in Article 4 below constitutes an electronic signature that has, between the Parties, the same value as a handwritten signature and is proof of the entire order and the requiredness of the sums due in the execution of the order.
1. THE PRODUCTS Pearls & Colors :
The products offered for sale by https://pearls-and-colors.com/eshop/ are those that appear on the Site, on the day of consultation of the Site by the User and within the limits of the available stocks.
If the product is not available, https://pearls-and-colors.com/eshop/ agrees to inform the User as soon as possible.
In the event of unavailability beyond 30 days of a Product ordered and paid, the Buyer will be notified by e-mail. The cancellation of the order of this Product and its refund will then be made, the rest of the order remaining firm and definitive.
Photographs and illustrations accompanying the products on the Site do not have a contractual value and are therefore not liable for https://pearls-and-colors.com/eshop/.
The Buyer is solely responsible for the choice of products, their conservation and their use.
2. THE PRICE SUBMITTED BY Pearls & Colors :
Prices are shown in euros. They take into account possible reductions as well as T.V.A., applicable to the order day.
https://pearls-and-colors.com/eshop/ reserves the right to modify its prices at any time but the Products will be billed on the basis of the tariffs in effect at the time of registration of the order unless typographic or omission error and subject to the availability of the said Products. The prices indicated do not take into account the shipping and packaging costs that will be charged in addition and will be specified to the User during the final validation of the order.
It is specified that any promotions granted in the form of discount vouchers are valid only for one order per home and for a given period of validity.
3. THE RESERVE OF PROPERTY:
The products remain the property of https://pearls-and-colors.com/eshop/, which reserves, to the full payment, a right of ownership over the Products sold, allowing it to take possession of the said products. Where applicable, any deposit paid by the Buyer will remain acquired to https://pearls-and-colors.com/eshop/ as a lump sum compensation, without prejudice to any other actions that it would be entitled to enter against the Buyer.
4.1. THE RETURN OF A COMMANDE ON THE SITE Pearls & Colors :
The User passes his order on the Internet and on the Site. In order to be accepted, the order must bear all indications useful to its treatment.
Any order is to accept the general conditions, prices and description of the products available for sale.
If the User wishes to place an order, he will choose the different Products to which he has an interest, and show the interest by clicking on the "Add to Cart" box.
At any time, the User may:
- get a summary of the products he selected, by clicking on "Your basket";
- continue its product selection by clicking on "Continue my purchases" and the product(s) of its choice;
- complete its product selection and order its products by clicking "Paypal".
To order the Products that he chose, after clicking on "Add to Cart", any User must identify himself or herself, either by entering his or her e-mail and password, or by filling in the appropriate form in the opposite case. In the latter case, the User will have to accurately complete the form available to the User, which will include the information necessary for his or her identification, including his or her names, first name, postal address and e-mail.
The User is informed and agrees that the entry of these two identifiers (e-mail address and password) will prove their identity and express their consent.
Once the User is identified, it will have to validate the delivery address (as specified in Article 6 below) and then a order confirmation will appear on the screen.
4.2. THE REVIEW OF YOUR COMMANDE:
The User checks his or her order with the proposed command summary on the screen. The User will then be able to set his order via paypal.
4.3. THE PAYPAL/BACKGROUND PAYMENT:
https://pearls-and-colors.com/eshop/ has established a secure procedure in partnership with Paypal. This procedure is based on information encryption technology, a real reference to secure payment.
Upon payment, the Purchaser records its bank card number and expiration date as well as the cryptogram number (three digit number on the back of the bank card) which are immediately encrypted. Thus, no confidential information circulates on the network without being previously encrypted.
Payment will be made, unless the server is unavailable, immediately via the Internet via Paypal.
Once the payment is made, an order confirmation email will be sent to the Purchaser.
4.4. LA CONFIRMATION DE LA COMMANDE PAR https://pearls-and-colors.com/eshop/ :
When it has validated its payment, a summary of the purchaser's order will be sent by e-mail to the e-mail address indicated by the purchaser at the time of the order. This confirmation will include all the elements of the contract between the Parties.
In any case, https://pearls-and-colors.com/eshop/ reserves the right to refuse any order or delivery in the event of a dispute with the Buyer, total or partial non-payment of a previous order by the Buyer, refusal of authorization to pay by bank card of the banking and insurance, non-payment or partial payment organizations. The liability of https://pearls-and-colors.com/eshop/ will in no case be incurred as such.
The Products are shipped with the supporting invoice, to the delivery address indicated by the Purchaser by filling the fields to be filled in during the order. In case the delivery address is different from the billing address, the products are accompanied by a delivery voucher summarizing the product list, without mentioning the prices.
5.1. THE LIVRAISONS:
The delivery times indicated are indicative deadlines from the day following the date of the purchaser's validation of the order and correspond to the maximum processing and delivery times of the Products. In no case can they be opposable. Any delay overtaking may not result in damages, retention or cancellation of the order by the Buyer. In the event of a delay in delivery in relation to the date initially set, the Buyer must report, within 15 days from the date of departure of the product(s), in writing (mail or mail) to https://pearls-and-colors.com/eshop/ to allow the latter to conduct an investigation with the Post Office. This investigation can last up to 21 working days. If, during this period, the product is found, it will be immediately forwarded to the address indicated by the Purchaser in its Order Form. If the product is not found after the 21 days of investigation, Pearls & Colors will carry out a new shipment of the product(s) ordered by the Buyer or the refund of the order.
If at the time of delivery, the original packaging is damaged, torn or open, you must then check the condition of the items. If damaged, you must absolutely refuse the parcel and note a reservation on the delivery slip (colis refused because opened or damaged).
